Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of Apex E-Learn (the "Platform"), operated by Apex E-Learn ("we," "us," or "our"). By creating an account, registering a child, or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Who May Use the Platform
The Platform is intended for use by parents and legal guardians ("Parent," "you") acting on behalf of a child ("Student," "Child") enrolled in our tracks. You must be at least 18 years old and have the legal authority to consent to your child's participation and enrollment. Children do not create their own accounts; all accounts belong to and are managed by a parent or guardian.
3. Account Registration
To use the Platform, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact details below if you suspect unauthorized access to your account.
4. Enrollment and Consent
When registering a child, you will be asked to provide certain information about the child (including name and age) and to confirm your consent to:
- Our collection and processing of your child's personal data for enrollment purposes; and
- Your child taking a placement assessment used to determine an appropriate starting level.
You confirm that you are the parent or legal guardian of the child being registered and that you have the authority to provide this consent on the child's behalf.
5. Tracks, Pricing, and Billing
Available tracks, subjects, and pricing are displayed on the Platform and may be updated from time to time. Prices are shown in Nigerian Naira (₦) and, where applicable, US Dollars ($) for reference. You may choose to pay for a track in full at the start of a term or in monthly installments, as offered at checkout. Prices for a track already enrolled and paid for will not change retroactively for that enrollment period.
6. Payments
Payments are processed through Paystack, a third-party payment processor. We do not store your full card or bank details. By making a payment, you agree to Paystack's own terms of service governing the payment transaction. All payments are settled to the account of the organization operating the tracks on the Platform.
7. Refunds and Cancellations
Refund eligibility depends on the specific circumstances of the request (for example, timing relative to the start of a term, and whether classes have already been attended). To request a refund or cancellation, please contact us through the Support Desk in your dashboard. We will review each request individually and respond within a reasonable time.
8. Live Classes on Third-Party Platforms
Classes are delivered live via third-party video conferencing services, including Zoom and Google Meet. Your use of these third-party platforms during a class is also subject to their respective terms of service and privacy policies. We are not responsible for outages, technical issues, or policies of these third-party services, though we will make reasonable efforts to communicate any disruption to scheduled classes.
9. Code of Conduct
Parents and students are expected to engage respectfully with instructors, staff, and other students. We reserve the right to suspend or terminate access to the Platform or to specific classes in cases of abusive, disruptive, or unsafe conduct.
10. Intellectual Property
All content on the Platform, including course materials, branding, graphics, and software, is the property of Apex E-Learn or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.
11. Limitation of Liability
To the fullest extent permitted by law, Apex E-Learn shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to interruptions caused by third-party services (such as Zoom, Google Meet, or Paystack) that are outside our direct control.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to registered users by email or through the dashboard. Continued use of the Platform after such changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.
